No-parole sentence reinstated for Minnesota man

MINNEAPOLIS (AP) -- A man who was 17 when prosecutors say he raped and killed a teenage girl with a screwdriver won't be eligible for release from prison.

The Minnesota Supreme Court on Wednesday reversed a lower court decision that gave Tony Roman Nose a chance to seek parole. The justices reinstated his original sentence of life without release.

Roman Nose was convicted in 2001 in the brutal killing of Jolene Stuedemann of Woodbury.

He received the mandatory sentence of life without release.

But years later the U.S. Supreme Court ruled these mandatory sentences were unconstitutional for juveniles. The U.S. Supreme Court didn't say if its decision was retroactive.

The Minnesota Supreme Court ruled earlier that the federal decision is not retroactive. On Wednesday, the justices say reinstating Roman Nose's original sentence ensures the fair administration of justice.
