BEMIDJI, Minn. (KFGO AM) -- A member of the Bemidji State University football team has been charged with 3rd degree criminal sexual conduct in Beltrami County Court.
Joshua Malone is accused of having sex with a woman, who was mentally impaired or rendered helpless.
If convicted, he faces up to 15 years in prison and a $30,000 fine.
According to court records, the victim had been playing drinking games at Malone's house during a February party, when she became highly intoxicated.
Malone told police that he carried the drunk woman to his room to take care of her.
In a statement to police, Malone said they had sex.
But, Malone says the victim was not unconscious at that time.
Malone has been suspended from the Bemidji State University football team, pending the outcome of the investigation.
